Limitation of Liability. The AE Ski Club is released of all liability for any action related in any way to this Agreement or to the services specified on the addendum(s) attached hereto shall be the full amount paid to AE Ski Club or its passengers related to this Agreement.
Indemnity. Group agrees to indemnify and hold harmless AE Ski Club from all costs, claims, liabilities, fees, attorney fees, and obligations (a) relating in any way to any act or omission of any person in or associated with the Group, (b) relating to any claim by any Group Member, or any person associated, affiliated or related to any Group member against AE Ski Club or its officers, employees, agents, or affiliates, except as to AE Ski Club’s active negligence and intentional misconduct. AE Ski Club agrees to indemnify and hold harmless Group from all costs, claims, liabilities, fees, attorney fees, and obligations related to harm caused by AE Ski Club’s negligence or intentional misconduct. Group agrees to be expressly and solely responsible for any damage or injury caused or suffered by any Group member, or any person associated, affiliated, or related to any Group member.
Waiver. I agree that neither AE Ski Club nor its affiliates, nor its or their volunteers, employees or agents, shall be liable for any damage, loss (including personal injury, death and property loss), inconvenience or expense occasioned by any act or omission of any supplier providing services, or of any other person, or by any change in itinerary, unless caused by the negligence of AE Ski Club or its affiliates or their employees or agents in the contractual duty. No person other than a representative of AE Ski Club authorized by a document in writing is permitted to vary, add or waive any term or condition in this Agreement, including any term or condition set forth in the preceding provisions.
Acknowledgment of Risk. I understand and agree that travel involves the risk of delays, inconveniences, cancellations, thefts, terrorism, crimes, and mechanical problems, as well as the risk of injuries. I accept responsibility for these risks for myself and my family. I understand and agree that such risks are not in AE Ski Club’s control and agree AE Ski Club nor its board members will be responsible for any harm or injury relating to such risks.
